1. PURPOSE
The UNIVERSITY OF ORADEA provides access to this portal, in order to publicize its educational services and the work of teachers in the service of students and potential academic partners.  "Welcome!" to all visitors! We recommend all visitors to read these terms and conditions carefully.
The only purpose allowed for the use of this portal is to obtain information about the educational service offer, the academic capacity of the University of Oradea and relevant educational and research materials. Any use for purposes other than the above is not permitted and is subject to the provisions of Romanian civil, non-criminal or criminal law.
The use, including reading or copying for exclusively private use, implies the unreserved acceptance of the terms and conditions detailed in the following paragraphs. They constitute AN AGREEMENT with legal value and regime of Contract, which has as parties the UNIVERSITY OF ORADEA and you (legal or natural person) as USER.

2. APPLICABLE LAW
The legislation according to which this Agreement was drawn up and will be carried out, and in accordance with which it is interpreted, is the Romanian legislation in the field and in force. It shall be complemented, as far as applicable, by the European Union reference rules.
By accessing (visiting or using) the portal, the USER agrees that the Romanian laws will govern the Terms and Conditions of use below and any dispute of any kind that may arise between them and the UNIVERSITY OF ORADEA. In the event of any conflicts, first of all, an attempt will be made to settle them amicably. If the amicable settlement is not possible, the conflict will be resolved by the competent Oradea courts in accordance with the law in force.

3. PROPRIETARY RIGHTS AND COPYRIGHT
THE UNIVERSITY OF ORADEA owns the portal and all the information contained therein. All content of this portal (consisting in an illustrative and not limited way in: images, text, graphics, symbols, web graphics, scripts, programs, drawings, photos, audio or video clips and other data) is the exclusive property of THE UNIVERSITY OF ORADEA and is defended in accordance with Law 8/1996.
Copyright for all information on this portal is wholly and exclusively owned by THE UNIVERSITY OF ORADEA or its nominated cedants. No material on this portal may be partially reproduced, wholly or modified without the prior express and written permission of THE UNIVERSITY OF ORADEA. All rights are reserved. The recipient is allowed to print or download to their personal computer – and only on them – sections of materials from different areas of the portal for exclusive academic and non-commercial use of their own.
Any other copying, redistribution, retransmission or publication of any downloaded material is strictly forbidden without the prior express written consent of THE UNIVERSITY OF ORADEA.
By accepting these terms and conditions THE USER agrees:
- not to modify all or part of any material originating from the materials downloaded from the portal.
- to offer THE UNIVERSITY OF ORADEA a non-exclusive license, without claims for copyright, throughout the world, continued, with the right to sublicense, reproduce, distribute, transmit, create derivative works, display or present to the public any materials and other information (including without limitation ideas contained therein for new or improved products and services) which it displays, in any way known or to be discovered, at the public portal locations.
-to give THE UNIVERSITY OF ORADEA the right to use the user's name in connection with the material or data displayed/input, and all the materials to promote the portal among teachers and students.
- that s/he will have no claim against THE UNIVERSITY OF ORADEA for any violation - alleged or true - of any right, a violation which does not arise from the exploitation of the portal.

4. PORTAL USAGE POLICY
4.1. USER RESPONSIBILITY
By accessing this portal, the user assumes the full risk and responsibility for using it and the Internet. THE UNIVERSITY OF ORADEA will exercise all due diligence to ensure the proper functioning of the portal, but it does not guarantee uninterrupted operation, error-free operation or unconditional correction. Under no circumstances will THE UNIVERSITY OF ORADEA be liable for any direct and/or indirect, principal and/or accessory damage arising from or in connection with the use or impossibility of using the portal.
THE UNIVERSITY OF ORADEA reserves the right to monitor the contents of the portal and to unilaterally remove those considered harmful or contrary to these conditions, morals, university ethics or legal rules.
4.2 RESTRICTIONS
In order to maintain an informative and valuable service, which meets the academic needs of users and avoids harm which may result from the dissemination of claims which are false, malicious or affecting the rights of third parties, the Parties shall agree the following rules for protection against abuse:
4.2.1 users will use only their actual first and last name.
4.2.2 it is prohibited to display or transmit any message which is defamatory, curiously or which discloses private or personal information of any third person. The user shall not be allowed to display or transmit any written material, data, images or programs that are indecent or obscene, that endangers human dignity or human rights.
4.2.3 the user shall not be permitted to display or transmit any written material, data, images or programs which would violate third party property rights, including unauthorized texts, images or programs without copyright, economic, military or other confidential information, protected trademarks or services.
4.2.4 the user is not permitted to display or transmit any material containing viruses or other destructive or contaminating electronic identities.
4.2.5 the user is not allowed to display or transmit any threatening messages, abusive or propausing discrimination of any kind.
4.2.6 the user is not allowed to use the portal's facilities and capabilities to perform activities that are contrary to the law or that violate or could violate third party rights.
4.2.7 attempting to probe or test the vulnerability of any system on the portal network, access to any non-public electronic servers or services belonging to THE UNIVERSITY OF ORADEA without the express, prior and written permission of the University of ORADEA are prohibited
4.2.8. any intervention or attempt to interfere, by any means, in the operation of servers serving the portal shall be prohibited.
4.3 PERSONAL DETAILS
THE USER is solely responsible for all activities that occur through access to their personal account and password. The UNVIERSITY OF ORADEA will not be liable for errors arising from the user's negligence regarding the security and confidentiality of their account and password.
The personal data of THE USER can be used by the UNIVERSITY OF ORADEA in accordance with the provisions of Law no. 677/2001 and Law no. 506/2004. Access to the portal and the entry of personal data represents the express consent to the processing of such data, including those of an identifying nature.

5. THE OBLIGATION TO REGISTER
To access certain portal sections, the user is required to:
1. provide real, accurate and complete data of their person as required by the registration form;
2. update the registration data in case of changes, within a maximum of 24 hours of the operation of such modifications.
By completing the registration form the user becomes a registered user. If you provide information that is not true, inaccurate or incomplete during the registration, the UNIVERSITY OF ORADEA has the unilateral right to restrict some or all of the access to the portal.

6. LIABILITY AND LIMITATIONS
By using this website, you expressly declare that you understand and agree to the following:
6.1. The use of the site is under the sole responsibility of the user. The user expressly releases THE UNIVERSITY OF ORADEA from any liability for the misuse of the portal.
6.2. THE UNIVERSITY OF ORADEA offers no guarantee that the portal will meet all requirements, but only those that are interdependant with the purpose of the portal.
6.3. Any material downloaded or obtained in any way permitted by the use of the portal is at the discretion of the user and can only be used at his/her own risk. The user is solely responsible for any damage caused to the computer from which he or she accesses the site or any other loss of data that may result from the download of the content of the site.
6.4. No information obtained BY THE USER will create a warranty which is not expressly stated in the Terms and Conditions of Use. THE UNIVERSITY OF ORADEA will not be liable for any direct, indirect, incidental, special damages, including, but not limited to, damage to loss of profit, possibility of use, data or other intangible or incalculable loss resulting from: (1) use or impossibility of using the site's information; (2) unauthorized access to user data or deterioration of the transmission of such data; (3) statements or actions by any third party on the portal; (4) any other issues related to the portal that are outside its scope of maintenance.
6.5. For sections of the portal that may contain user opinions, the full responsibility for the content of their opinions shall lie with the authors. THE UNIVERSITY OF ORADEA reserves the right not to disclose those opinions which it considers harmful in any form to the policy or image of the institution, morale and/or legal provisions. By accepting these terms and conditions the user agrees to protect, insure and defend THE UNIVERSITY OF ORADEA against any claims, claims, losses, expenses, direct and/or indirect damages resulting from a breach of these terms by the user, his agent or agent.
6.6. This portal is provided in this form without any further guarantees and in no case will THE UNIVERSITY OF ORADEA be liable for any damage to users, computer systems or other equipment.
6.7. Force majeure, as defined by Romanian law, exonerates the parties to this agreement from liability
6.8. THE UNIVERSITY OF ORADEA has the right to use or process any data entered in this portal, including personal data.

7. AMENDMENT OF THE AGREEMENT
THE UNIVERSITY OF ORADEA reserves the right to modify any of the terms and conditions contained in this Agreement, any Appendix and any policies included or referred to at any time unilaterally, and determine when such changes apply to both current and future users. Any changes or modifications will take effect after they are displayed in this section. The continued use of the service by users after modifying these terms and conditions constitutes a tacit agreement and will be perceived as such.

8. FINAL PROVISIONS
If any of the above clauses is found void or invalid, whatever the cause, it will not affect the validity of the other clauses, which will continue to have effect.
The legal regime of the Terms and Conditions is that of a valid contract concluded.
Failure by THE UNIVERSITY OF ORADEA to exercise any right under this Agreement shall in no way constitute a waiver of that right.

9. DEFINITIONS AND TERMS DETAIL
UNIVERSITY OF ORADEA = Romanian legal entity, with headquarters in Romania, Oradea, No. 1 Universitatii street, legally represented by the Rector.
PORTAL = portal accessible at the address: admitere.uoradea.ro.
USER = any person accessing the portal; the term includes both people visiting the portal in public sections that do not require registration (visitors) and the persons registered by the registration form (registered users).
DATA = any information that may enable or facilitate the performance of types of operations related to Internet access, such as an identification code, name or address, place of residence or place of business, telephone number, fax, e-mail address, registration number or other similar means of identification, tax registration code, the personal id and other such, including information on academic, educational and research activities.
COPYRIGHT ON CONTENT = according to art. 72 paragraph 1 of Law 8/1996, protection of computer programs 'includes any expression of a program, application programs and operating systems, expressed in any language, either in source code or object code, preparatory design material, as well as manuals.’;
LICENSE = the copyright holder's agreement to the assignment of rights to a third party ("non-exclusive license", in text, i.e. the non-exclusive license for the third party).
ACCESS = for the purposes of this Agreement, the stage of Internet browsing that is characterized by visiting or using a registered domain on the Internet dedicated to a specific activity.
SERVER = the server assembly on which the portal is hosted.
